Police call on DA's office

ASHLAND -- Police are consulting the district attorney's office as part of an investigation into an accident that sent an 18-year-old woman to the hospital Saturday after she was run over by a teenage driver.

Police have not filed charges against Scott Riggs, 17, of 9 Sunset Drive, Milford, who likely mistook the gas for the brake pedal, police said. Police have four days to issue a citation, Sgt. Roy Testa said yesterday.

Lindsay Tlumacki, an employee at Tasty Treat & Miniature Golf and a Holliston High School graduate, was taken by helicopter to UMass Memorial Trauma Center after suffering injuries to her legs and pelvis in the accident.

Tlumacki, of 45 Dalton Road, was in fair condition yesterday, a nursing supervisor said.

Riggs was "very concerned" about Tlumacki after the accident, said Officer William Foster, who was at the scene Saturday.

Riggs was driving a 2002 Isuzu Axiom sports utility vehicle, practicing with his learner's permit, which police said he had for more than a year. He was accompanied by his mother, Mary Riggs, police said.

Tlumacki was stepping out the front door of Tasty Treat on Union Avenue just before 11 a.m. when Riggs was pulling in.

Riggs confused the brake with the gas as he tried to park, police said. He swerved right to avoid hitting the building head on and cut the wheel so fast he left yaw marks on the pavement, Testa said. In the process, the driver knocked down a support pole and hit the woman. Then the SUV "bounced off the building" Testa said.

Tlumacki was conscious but had many cuts on her body when she was removed from beneath the SUV and flown to Worcester, Testa said.

Tlumacki made the high honor roll while at Holliston High School and was also a varsity tennis player. She was named to the dean's list this year at the University of Maryland.
